Terms and conditions
These general conditions exclusively govern the contractual relations between Cogentis B.V. and any person consulting the site www.biorca.eu or wishing to make the purchase of one of the products offered on this site, the Customer.
By browsing the www.biorca.eu site or by ordering one of the products offered on this site, the Customer agrees to be bound by these conditions which apply to any offer, order and agreement between the Client and the Company, as well as any operation necessary for their execution, to the exclusion of any other condition formulated by the Client, without the Company's written agreement.
These conditions are available to everyone on the Company's website (www.biorca.eu).
The Company reserves the right to modify these general conditions at any time, subject to making these modifications appear on its website.
If all or part of one or more provisions should be declared invalid, this invalidity will not affect the other provisions or parts of provision which will remain fully applicable.
The payment conditions are subject to the strict decision of biorca.eu and unless specific approval the receipt of payment precedes any acceptance of order. Orders can be placed on the www.biorca.eu site by credit card, Paypal, bank transfer or by any other means subject to a prior agreement between Biorca® and the customer. Any order implies acceptance of the prices and description of the products. Orders must be confirmed by the Company.
The Company reserves the right to refuse orders placed by customers with whom there is a dispute. Furthermore, the Company reserves the right to refuse orders and therefore deliveries to certain countries outside Community Europe, the United States and Canada without having to justify its decision.
The Company undertakes to fulfill orders only within the limits of available stocks of products. If the ordered product is not available, the Company undertakes to inform the Customer as soon as possible.
All product prices are valid only while stocks last.
The costs for the delivery of the goods are borne by the Customer. The mode of transport varies according to the weight of the order and the distance from the destination country. The transport costs applicable to the Customer's order are communicated during the order procedure.
Any customs or import taxes are due as soon as the package reaches its country of destination. The Customer must pay any additional customs clearance taxes, the Company having no control over these taxes and being unable to predict them, customs policies vary widely from one country to another. It is therefore the responsibility of the Customer to inquire with the local customs office in order to know the amount of taxes due.
4. Delivery of orders
Unless otherwise provided, delivery is made to the address specified by the Customer when ordering. In the absence of the Customer at the time of delivery, the products ordered will then be delivered to the post office on which depends the delivery address indicated by the Customer when ordering.
Except in special cases or temporary unavailability of one or more items, the items ordered are shipped within 3 business days.
The Company undertakes to make deliveries of the products ordered as soon as possible. In the event of delivery outside Europe, delivery times vary depending on the remoteness of the recipient country.
5. Property and risk transfer
The products delivered to the Customer remain the property of the Company until actual payment of the full price.
The risks in terms of damage, loss or theft are assumed by the Company until the moment of delivery of the goods to the Customer. From that moment, the risks fall to the Customer.
6. Product returns and exchanges
The Customer has the right to notify the Company that he renounces his purchase without penalty and without giving reasons within a maximum of 14 days from the day after the day of delivery. The products must then be returned at the customer's expense in their original packaging, unopened and not soiled or damaged to the following address:

The amount paid by the Customer will be returned to his account within 14 working days of the Company's receipt of the returned products and the customer's bank details.
If, upon delivery, the product or products do not correspond to the order, have defects or are damaged, the Customer may submit a request for a refund or exchange within 7 working days from the day after delivery day, provided that the product is in its original packaging, undamaged and that the reasons for return are clearly indicated.
The product (s) and the request for exchange or refund must be sent, at the Customer's expense, together with a photocopy of the purchase invoice.
7. Applicable law and competent courts
The contractual relations between the Client and the Company are governed by netherlands law. In the event of a dispute between the Client and the Company, the netherlands courts have sole jurisdiction.
